How Do 55+ Communities Get Away with Age Discrimination?

The Fair Housing Act (FHAct) protects all citizens from discrimination on the basis of race, color, national origin, religion, sex, handicap or familial status.  When it comes to senior housing, Congress created an exemption from the familial status requirements as long as the housing  is specifically for at least one person who is 55 or older in at least 80 percent of the occupied units and adheres to a policy that demonstrates intent to house persons who are 55 or older.
